Final Determination and Appeal
The Office published its final Determination on 21 September 2000. United Energy Distribution was not satisfied with the Office's Determination, and lodged an appeal against it on 2 October 2000.
The appeal was lodged under section 38 of the Office of the Regulator-General Act 1994. The appeal was heard before a three person panel which was appointed by the Minister for Finance. The panel was selected from a pool of people appointed by the Governor in Council.
According to the Act, the appeal needed to be conducted over a very short timeframe. United Energy Distribution was required to lodge its appeal within seven working days of the Determination's publication. The panel was then required to hear the appeal and make a decision within two weeks of the lodgment of the appeal. Two weeks after it published its decision, the appeal panel published the reasons for its decision.
