Appeal Outcome

In its decision, the appeal panel required that the Determination be set aside and remitted to the Office for amendment on two of the four grounds of United Energy Distribution's appeal.

On the basis of the appeals by the distribution businesses and the decision by the panel, the Office published a Re-Determination on 1 December 2000.

Although the Re-Determination did not represent incentive regulation as argued for by United Energy Distribution, we were nevertheless satisfied with the outcome of the Re-Determination.
